Terms of Service

These Terms of Service ("Terms") govern your access to and use of CallCanvas AI ("the Service"), operated by YWM Consulting (a sole proprietorship based in Sugar Grove, Illinois, USA). By using the Service, you agree to these Terms.

1. The Service

CallCanvas AI is an AI-powered territory research tool for outside sales representatives. You provide a city or ZIP code and a description of what you sell. The Service generates a ranked list of local businesses with owner/decision-maker names, phone numbers, and personalized opening lines for cold outreach.

2. Subscription and trial

• Free trial: 7 days, no credit card required to start. After day 7, the subscription begins automatically only if you provided payment information during signup.
• Subscription price: $59 per month, billed monthly in advance. Price subject to change with 30 days notice.
• Auto-renewal: Subscriptions renew automatically each month until you cancel.
• Cancellation: You may cancel anytime via the "Manage subscription" link on our homepage. Your access continues until the end of your current billing period.

3. 30-day money-back guarantee

If you are not satisfied with the Service within the first 30 days of your first paid month, email support@callcanvasai.com and we will refund your most recent payment, no questions asked. This guarantee applies to your first paid subscription period only.

4. Acceptable use

You agree NOT to:

• Resell, sublicense, or redistribute the Service or its output
• Share your account with other users (one rep per subscription)
• Use the Service to generate spam, harassment, or unsolicited mass communications
• Reverse-engineer, scrape, or attempt to access the Service\'s underlying systems
• Use the Service for any unlawful purpose or in violation of any third party\'s rights
• Use generated lists for purposes other than your own outside sales activities

Generated output is watermarked with your account email and the generation timestamp. Sharing or using output outside the scope of an active subscription is a violation of these Terms and may result in termination.

5. Intellectual property

• Our property: The Service\'s software, design, and brand are owned by YWM Consulting. You may not copy, modify, or create derivative works of the Service.
• Your data: You own the data you submit (your territory queries, your business name, etc.).
• Generated output: While you may use generated lists for your own sales activities, the AI-generated content is licensed (not sold) to you for use during your active subscription. Access to use generated content ends when your subscription ends.

6. Service availability

We aim for high uptime but do not guarantee uninterrupted service. The Service depends on third-party providers (Stripe, Anthropic, Netlify) which may experience outages. We are not liable for downtime caused by third-party providers, but we will make reasonable efforts to restore service quickly.

7. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee:

• That generated prospect information is current, accurate, or complete (business records change frequently)
• That use of the Service will result in any specific sales outcomes
• That the Service will be free from errors or interruptions

You are responsible for verifying prospect information before use, complying with do-not-call laws (TCPA, state-level laws), and conducting your business in accordance with applicable regulations.

8. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months prior to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Termination

We may suspend or terminate your account if you violate these Terms, abuse the Service, or fail to pay. You may terminate your account at any time via self-serve cancellation or by emailing support. Upon termination, your access ends and your data is deleted within 90 days (except where retention is required by law).

10. Governing law

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws principles. Any dispute arising from these Terms will be resolved in the state or federal courts located in Kane County, Illinois.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will be communicated via email to active subscribers at least 30 days before taking effect.
